Terms of Service for Commissions.

_{By commissioning, the Client agrees to have read, understood, and agreed to all the terms listed below.
By sending payment, the Client will have agreed to the below terms given by the Artist.}

The terms listed below are in relation to Non-Commercial projects only.
_{Commercial projects are to be discussed through Email, where prices and terms will be provided.}

General Terms
• I can decline any commission, with or without explaination.
• I can change any commission information and pricing. Previously agreed upon pricing or information will not be affected.
• I reserve the right to blacklist any commissioner at any time for reasons pertaining to unreceived payment, poor communication / innapropriate behavior, any form of abuse or otherwise based on my best judgement.• All commissions are digital, they will not be shipped to the customer.
• All commissions will be illustrated in my style only. I will not copy other styles.
• I do not take deadlines, unless discussed otherwise. I work Monday - Friday. Commissions will be completed within 1 week - 6 months, variable by details of commissions. This also depends on the client's response time.

Copyright and Usage
• I retain full creator rights/copyright to all works.
• I reserve the right to display all works publicly, and be used in the advertisement of my portfolio and commission examples. Very personal commissions (family, pets, etc.) will not be displayed unless permission is given by the client.
• I do not allow any work I have created to be used or uploaded as NFTs and/or used in the use of any AI generators in any shape or form.• No commission may be edited without given permission. This includes the removal of my watermarks/signatures.
• Commissioner may not claim, trace, or recreate my work in any way.
• Commissioner cannot use any of my work for commercial use or for the purpose/benefit of profiting.
• Commissioner may only use artwork that they have commissioned, and is for their personal use only. This includes in the usage of wallpapers, avatars/profile pictures, personal display, or otherwise.
• Commissioner is not allowed to share and upload an un-waternarked commission to an online gallery, website, or social media.
• Commissioner is allowed to share and upload their personally commissioned artworks to an online gallery, website, or social media, provided that credit is given to myself / my social media. (e.g. Artwork by TheJokingJester/Jester/SlumberingFool - link to social media)
• All commissioners retain the right to remain anonymous if desired when/if the commissioned artwork is shared on my Social Media.
• All commissioners retain the right to Intellectual Property (IP).

Commission Process
• A complete redraw of any type of commission will be considered a separate commission, and will be charged as such.
• Once a completed commission has been received, it is advised that the commissioner save it. I am not to be held liable for any unforeseen losses of files of commissioned work once a commission has been completed and sent.
• Communication will be maintained throughout the duration of the commission process. This includes me providing progress updates, notices on delays, any discussed revisions, and anything else pertaining directly to the relevant commission.• Commissioner must be clear and concise about their desired commission when submitting a request. I am not to be held liable should the commissioner fail to communicate the necessary details upfront and receive a result they are not happy with. Please double check before submitting a commission request.
• Commissioner may request to see process images at any stage of the commission. If desired, the client may request to not see any progress images past the sketch phase.
• Commissioner may request up to 3 major revisions during the sketching process.(pose change, background change, outfit change, etc.) Anything more or beyond the sketch will incur a fee of 10 USD or more depending on desired change. Small details such as eye color, moles, small scars, etc. do not count towards this.
• At the start of a commission, the client will receive a sketch for approval and revision before continuing. Each stage will be sent for approval. This includes the sketch, cleaned sketch, lines and flat colors, rendering / final details.

Payment Process
• All commissions are to be paid through PayPal only. (USD) Payments will be made via Invoice only, which will be sent once commission details, pricing, and payment has been thoroughly discussed and agreed upon.
• Full payment is required upfront, commission progress will not start until it is received. Payment plans may be discussed, however, half will always be required upfront. The rest may be paid over an agreed period of time or at a later date. The commissioner will receive the completed artwork once full payment is received.• Commissioner agrees to not request a Paypal chargeback at any time.
• Commissioner will have 48 hours (2 days) to pay the agreed amount for the commission.

Refund Policy
• If receiving a refund, commissioner may not request a PayPal chargeback. I will be refunding the money back directly.
• I reserve the right to cancel and refund a commission at any time with provided notification to commissioner, no reason is required to be given.• Refunds may be requested at any time. Refunded amount will be determined by the amount of work completed.
• Commissions unable to be started or completed will receive a refund.
• Commissioner may not receive a full refund once a commission is past the clean sketch stage. Full refunds are valid only during the sketching process.
• Commissioner will receive a high-quality PNG file of what has been completed up until time of refund.

NSFW Commissions
• I will not draw anything that violates laws. Including anything that is perceived as loli, shota, SA, etc.
• I will not draw anything that involves weird or extreme fetishes. (inflation, hyper, vore, etc.)
• I will not draw anything that involves my own characters.

• Commissioner must be 18 or older to purchase anything NSFW.
• Commissioner agrees to be respectful and decent throughout the commission process.
• I reserve the right to cancel at any time if I feel uncomfortable with completing the commission or the commissioner behaves inappropriately.

By commissioning, the Client agrees to have read, understood, and agreed to all the terms listed above.
By sending payment, the Client will have agreed to the above terms given by the Artist.

Cost of shipping included in price for non-bulk orders within the United States, Canada, & Mexico.
Please note that colors may be slightly altered in the final product when compared to the digital file.
This is unfortunately not something that is able to be helped, but the colors will be matched as closely as possible.
If there are any defects, such as white blotches or otherwise, it will be immediately corrected.}
